Mother alleges Kroger pharmacy's wrong prescription injured son

BEAUMONT — A Beaumont mother is suing Kroger, alleging it gave her son the wrong medication.

Maria Acabado, on behalf of Mandelson Acabado, a minor child, filed a lawsuit July 8 in Jefferson County District Court against Kroger Texas LP, alleging negligence in filling a prescription with the wrong medication.

According to the complaint, on June 29, 2015,  Mandelson Acabado was prescribed medication by his physician but after taking the medicine for nearly two months, he started experiencing high blood pressure, vomiting, low energy, fatigue and drowsiness. The suit says the medication was supplied by a Kroger pharmacy, 3845 Phelan Blvd., Beaumont

The plaintiff alleges Kroger Texas failed to properly supervise its pharmacy technicians, failed to review its policies and procedures for filling prescriptions and failed to assign adequate number of pharmacists and pharmacy technicians.

Maria Acabado seeks a trial by jury, judgment to be determined at trial, plus interest, costs of court and such other relief to which she is entitled. She is represented by attorney Rocky Lawdermilk of the Law Office of Rocky Lawdermilk in Beaumont.
