Frisco consumer accuses collection agencies of harassment

SHERMAN — A Frisco man is suing collection agencies, alleging unconscionable collection practices.

Domingo Zuniga filed a class action lawsuit, individually and on behalf of all others similarly situated, July 15 in the Sherman Division of the Eastern District of Texas against Jefferson Capital Systems LLC and Financial Business and Consumer Solutions, Inc., doing business as FBCS Inc., alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, Zuniga was deprived of material information and was harassed and abused by the defendants' use of false or deceptive statements in connection with debt collection attempts. 

The plaintiff alleges the defendants used abusive debt collection practices, demanded payment of a time-barred debt and engaged in unfair and deceptive acts and practices by sending letters, offering to settle time-barred debts.

Zuniga seeks a trial by jury, actual and statutory damages, attorney fees, litigation expenses and such other relief as the court deems proper. He is represented by attorney Jerry J. Jarzombek of The Law Office of Jerry Jarzombek PLLC in Fort Worth.
