Husband seeks recovery of benefits from TransAmerica Life

GALVESTON – A man has filed suit against an insurance company alleging he was not paid life insurance benefits after the death of his wife.

Ruben N. Saenz, individually and representative of the estate of Decideria Saenz, deceased, filed a complaint on July 18 in the Galveston County District Court against TransAmerica Life Insurance Co. alleging that the insurance company violated the Texas Deceptive Trade Practices Act and the Texas Insurance Code, fraud and other counts.

According to the complaint, the plaintiff alleges that he has not received payment for his claim for credit life insurance benefits for the death of his wife in January. The plaintiff holds TransAmerica Life Insurance Co. responsible because the defendant allegedly refused to pay his claim without making a reasonable investigation, failed to provide a reasonable explanation for denying or compromising his claim and failed to effectuate a prompt, fair and equitable settlement of the claim.

The plaintiff requests a trial by jury and seeks compensatory damages and additional damages, attorney's fees and costs, pre- and post-judgment interest and such other and further relief as the court deems appropriate. He is represented by Frederick L. Fuhr of The Fuhr Law Firm in League City.
