Customer accuses Mercedes dealer of deceptive trade practices

HOUSTON — A Harris County man is suing a Mercedes car dealer, alleging deceptive trade practices.

Bill Millican Jr. filed a lawsuit July 27 in Harris County District Court against Mercedes Benz of Houston North, alleging the car dealer violated the Texas Deceptive Trade Practices - Consumer Protection Act.

According to the complaint, on Nov. 4, 2014, Millican purchased a new 2015 Mercedes GL 350 Bluetec that he later discovered had been in the AutoNation Collision Center twice before for collision damage and repairs. 

The plaintiff alleges the defendant represented the vehicle as new, failed to disclose that it had been used by United Airlines to shuttle employees and alleged there was no other wear or damage to the vehicle.

Millican seeks a trial by jury, up to $100,000, pre- and post-judgment interest, attorney fees, legal costs and all such other relief to which he is entitled. He is represented by attorneys Jason H. G. Truitt and Kathryn P. Anderson of The Anderson Firm LLC in Houston.
