Surgical assistant alleges former employers failed to pay overtime

HOUSTON — A Harris County man is suing a Missouri City health business, alleging failure to pay proper overtime wages.

Alfonso Jose Bravo filed a lawsuit Aug. 9 in the Houston Division of the Southern District of Texas against Umbrella Surgical Support LC and Estuardo A. Mota, doing business as Professional Surgical Services, alleging violation of the Fair Labor Standards Act.

According to the complaint, Bravo regularly worked from 2003 until May 2016 as a surgical assistant for more than 40 hours a week. The suit says Bravo was not paid one and one half times his regular rate of pay for all hours worked of more than 40 each week as required by FLSA regulations. 

The lawsuit states Bravo was paid a day rate, plus a flat amount of additional money for being on call. The plaintiff alleges the defendants failed to pay him the proper overtime compensation.

Bravo seeks trial by jury, unpaid overtime wages, an equal amount as liquidated damages, pre- and post-judgment interest, all court costs and attorney fees, plus all relief the court deems just and equitable. He is represented by attorneys Josef F. Buenker and Vijay A. Pattisapu of Buenker Law Firm in Houston.
