Davis Chemical Services alleged owes more than $2 million for equipment lease

MARSHALL – A Marshall company is accused of not paying for an equipment lease.

United Leasing Inc. filed a complaint in the Marshall Division of the Eastern District of Texas against Davis Chemical Services LLC alleging breach of contract.

According to the complaint, the plaintiff alleges that in March 30, 2015, Scott Capital assigned defendant's collateral assignment to plaintiff in connection with a loan and security agreement for equipment. Despite sending notice of default and demand for payment, the outstanding balance due in the amount of $2,057,813.81 allegedly remains unpaid. The plaintiff holds Davis Chemical Services LLC responsible because the defendant allegedly failed to make timely payments due from and after February and violated the financial covenant set forth in the master equipment lease schedule.

The plaintiff requests a trial by jury and seeks judgment against defendant in the amount of $2,278,305.56, award of reasonable attorney's fees and costs of court, pre- and post-judgment interest and such other and further relief.
