Smith County woman blames Dillard's for fall on broken escalator

MARSHALL — A Smith County woman is suing Dillard's, alleging the defendant's negligence caused the plaintiff is to sustain injuries on an escalator.

Mattie Moore filed a lawsuit Aug. 22 in the Marshall Division of the Eastern District of Texas against Dillard's Inc. alleging negligence in failing to protect its patrons.

According to the complaint, on Sept. 10, 2015, Moore was on the premises of Dillard's in Tyler to purchase goods. While on the escalator, the suit says, it suddenly malfunctioned, throwing Moore to the floor.

The lawsuit states Moore sustained severe and disabling injuries that resulted in pain, mental anguish, loss of earnings, physical impairment, disfigurement and medical expenses. The plaintiff alleges Dillard's failed to perform routine maintenance on the escalator, failed to inspect and repair the escalator and failed to warn invitees that the escalator could malfunction and cause serious injury.

Moore seeks trial by jury, actual damages, costs of court, pre- and post-judgment interest, punitive and/or exemplary damages, attorney fees and all other relief. She is represented by attorney Luke Bickham of Tyler.
