Dietary manager accuses rehab facility of violating law

TYLER — A Smith County woman is suing a Henderson County nursing and rehabilitation facility, alleging unlawful employment practices.

Linsley Johnson filed a lawsuit Sept. 7 in the Tyler Division of the Eastern District of Texas against Green Oaks SNF, LLC, doing business as Green Oaks Rehab & Nursing, alleging violation of Title VII of the 1964 Civil Rights Act.

According to the complaint, on April 26, 2015, Johnson, who had worked at Green Oaks Rehab & Nursing for 5 1/2 years as a dietary manager, was involved in an auto accident that resulted in her right foot's amputation. The suit says on Aug. 25, 2015, Johnson informed the defendant that her doctor was not yet ready to release her to full duty and she requested either an extension of her Family and Medical Leave Act leave or an accommodation to work half-days. 

Instead, the lawsuit states, she was terminated Aug. 27, 2015, allegedly because she had exhausted all of her FMLA leave time. As a result of defendant's discrimination, the suit states, Johnson has suffered lost wages and benefits and lost employment opportunities. 

The plaintiff alleges the defendant refused to make reasonable accommodations. 

Johnson seeks trial by jury, compensatory damages to be determined at trial, attorney fees, court costs and all other relief as is just and proper. She is represented by attorney William S. Hommel Jr of Tyler.
