Ermelinda Nolan filed the suit against Williston Holding Company, Mexican Restaurants Inc., and Casa Ole Store 618 on Oct. 11 in Jefferson County District Court.
According to the lawsuit, on May 22 Nolan went to the Beaumont Casa Ole. While approaching the restaurant, she tripped over a brick allegedly hidden from view.
“Defendants failed to post a warning, alerting plaintiff of the hidden danger posed by an out of sight obstacle,” the suit states.
Nolan heard a pop as she fell and sustained numerous injuries, including a broken “humerous” and partial shoulder replacement.
“These injuries required invasive surgeries involving multiple procedures as well as continuing physical therapy,” the suit states.
The defendants are accused of negligently allowing the dangerous condition to exist.
Seeking between $200,000 and $1 million in damages, Nolan is suing for her physical and mental pain, suffering, impairment, loss of enjoyment of life and disability.
