Plano couple alleges GM vehicle design defect led to child's death

SHERMAN — A Plano husband and wife are suing General Motors, alleging a manufacturing defect led to the death of their child.

Mark Conboy and Misti Conboy, individually and as next friends to C.C., a minor child, as well as representatives of the estate of A.C., a deceased minor, filed a lawsuit Oct. 3 in the Sherman Division of the Eastern District of Texas against General Motors LLC, alleging failure to comply with the Federal Motor Vehicle Safety Standard.

According to the complaint, on June 12, Mark Conboy was driving a 2011 Chevrolet Suburban, and C.C., a minor child, and A.C., another minor, were passengers. For unknown reasons, the suit says, Conboy lost control of the vehicle and it struck a guard rail. 

The lawsuit states Conboy sustained serious injuries and A.C. sustained fatal injuries. The plaintiffs allege General Motors negligently designed, manufactured and assembled the vehicle, failed to provide proper restraint and failed to use safer alternative designs.

The Conboys seeks trial by jury, all damages, pre- and and post-judgment interest, costs of suit and all other relief as the court deems proper. They are represented by E. Todd Tracy, Stewart D. Matthews and Andrew G. Counts of The Tracy Firm in Dallas.
