Micaela Lopez Cruz lodged the complaint in the District Court of Harris County, Texas, on February 27, 2025, accusing Ross Dress for Less, Inc. of negligence leading to her injuries.
The lawsuit details how on August 9, 2023, Lopez Cruz was shopping at a Ross Dress for Less store located in Houston when she slipped on a wet floor in the dressing room. The fall resulted in significant injuries to her right arm and head. Lopez Cruz asserts that the defendant's failure to maintain safe premises directly caused her injuries. She claims that Ross Dress for Less neglected their duty by not monitoring or cleaning the floor adequately and failing to warn customers about the hazardous condition. The complaint accuses the company of gross negligence and premises liability, arguing that they knew or should have known about the dangerous condition but did nothing to rectify it.
Lopez Cruz's legal filing goes further to allege negligent hiring, training, supervision, and retention by Ross Dress for Less.
