Beaumont ISD named in potential ‘spanked’ lawsuit

BEAUMONT – The Beaumont Independent School District may soon be a defendant in a lawsuit accusing an elementary school teacher of spanking a 6-year old student “without provocation.”

Individually and as next of friend for their adopted son, Nora and Todd Trahan filed a petition for depositions on Nov. 7 in Jefferson County District Court.

According to the petition, the minor boy, identified as T.T. in the litigation, attended Martin Elementary school.

On Oct. 19, T.T. was standing in the bus line when a scuffle between him and another boy broke out. T.T.’s teacher, Ms. Dennis, settled the children down and “things returned to normal.”

“Some time after, the other student’s teacher (Ms. Brewer) approached, and without warning or provocation, grabbed, pulled, yanked, spanked and struck 6-year old T.T.,” the petition states.

Prior to his adoption, T.T. has been the victim of abuse. As a result, he has become a fragile and fearful child, according to the petition.

His parents had implemented a “no spanking” order, which the BISD staff at Martin Elementary was aware of, the petition claims.

“T.T. was so traumatized from this event that his parents withheld him from school and attempted to transfer him elsewhere. BISD refused,” the petition states.

“Petitioners seek to investigate potential claims as a result of this incident.”

T.T.’s parents seek to depose both of the aforementioned teachers and the school’s counselor and principal, plus the custodian of records.

They are represented by Beaumont attorney Paul “Chip” Ferguson Jr.

Judge Donald Floyd, 172nd District Court, has been assigned to the case.
