MARSHALL – A black man alleges his former Palestine employer discriminated against him because of his race.

Billy Farris filed a complaint on Oct. 13 in the Marshall Division of the Eastern District of Texas against Ben E. Keith Co. alleging that the employer violated Title VII, and the Civil Rights Act.

According to the complaint, the plaintiff alleges that in Oct. 20, 2015, he was terminated for being a penny short. As a result, he alleges he has suffered damages for lost wages and fringe benefits. He also claims he has suffered the loss of future earnings and benefits and mental anguish. The plaintiff holds Ben E. Keith Co. responsible because the defendant allegedly subjected him to racial discrimination, disparate treatment and termination because of his race.

The plaintiff requests a trial by jury and seeks award for compensatory and punitive damages, including attorney's fees and costs of experts in this litigation and such other and further relief. He is represented by Bob Whitehurst of Whitehurst Law Firm in Tyler.
