Houston consumer alleges debt collector broke law

HOUSTON — A Houston man is suing a debt collector, alleging unfair and unconscionable collection practices.

Brian Murph filed a lawsuit Nov. 22 in the Houston Division of the Southern District of Texas against Gatestone & Co. International Inc., alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, as a result of defendant’s unlawful conduct, Murph has suffered humiliation, anger, anxiety, emotional distress, fear, frustration and embarrassment. The plaintiff alleges Gatestone engaged in behavior to harass, oppress or abuse him in connection with collection of an alleged debt by threatening to call his family members if he would not pay immediately.

Murphy seeks trial by jury, actual damages, statutory damages of $1,000, attorney fees and all other just and proper relief. He is represented by attorney Jenny DeFrancisco of Lemberg Law PLLC in Wilton, Connecticut.
