Dallas County woman says Mosaic Residential failed to repair water leaks

GALVESTON — A Dallas County woman is suing Mosaic Residential Inc., Mosaic Residential GP LLC and Mosaic Residential II LP, citing alleged insufficient measures were taken to prevent injuries and damages.

Wendy Treat filed a complaint on Jan. 11 in the Galveston County District Court against the defendants alleging that they failed to provide an apartment unit free from unreasonably dangerous condition.

According to the complaint, Treat alleges that in April 24, 2015, rainwater leaked from deficient drainage mechanisms in her apartment, causing water to seep into her unit. Despite repeated reports to the defendants, the leak was not fixed, causing her to sustain personal injury and property damage. Treat holds Mosaic Residential, Mosaic Residential GP and Mosaic Residential II responsible because the defendants allegedly breached their duty to exercise ordinary care and caution in the operation, maintenance and management of their premises by failing to repair or remedy said condition.

Treat requests a trial by jury and seeks actual, special and punitive damages, attorney's fees, costs and such other just and equitable relief. She is represented by Austin F. Hartley in Dallas.
