On Dec. 15, the city notified residents about a potential chemical spill contaminating the city’s water supply. The incident made national headlines.
City officials identified Ergon Asphalt & Emulsions as the source of the contamination, suspecting a backflow incident caused the release of the chemical INDULIN-AA-86.
Two days after the city’s notice, a class action lawsuit was brought against Valero and Ergon.
Seeking more than $1 million in damages, Martina Robledo, doing business as Lilia’s Mexican Restaurant, filed suit against the two companies in Nueces County District Court.
The proposed class seeks all city restaurants affected by the discontinuation of tap water usage notice, which is possibly more than 1,000 restaurants, according to the petition.
Court records show that on Jan. 10 Ergon filed a notice of remove. A motion to transfer venue was also filed.
No order on the motion is on file as of Feb. 3.
Court records further show that Valero also answered the suit on Jan. 10.
