Father blames Walmart for child's injuries

HOUSTON — A father is suing Walmart, alleging a store's negligence resulted in injuries to his daughter. 

James Nguyen, individually and as next friend to J.N., a minor child, filed a complaint Jan. 17 in Harris County District Court against Wal-Mart Stores Inc., alleging failure to to provide a safe environment.

According to the complaint, on Jan. 30, 2015, Nguyen daughter, J.N., was shopping at the defendant's Sam's Club off the Katy Freeway in Houston. The suit says she sustained serious injuries after the bench provided by defendant was detached from the floor and fell backward, causing her back and head to slam on the floor. The lawsuit says she suffered physical pain and mental anguish, plus medical costs. 

The plaintiff alleges Walmart negligently permitted the existence of a dangerous condition on its premises and failed to give adequate warning of the unsafe condition of the bench.

Nguyen seeks trial by jury, compensation not to exceed $100,000, pre- and post-judgment interest, costs of court and all other equitable relief. He is represented by attorney Joshua Estes of The Estes Law Firm PC in Richmond.
