Safety supervisor alleges petrochemical companies failed to pay overtime

HOUSTON — A Brazoria County man has filed a class action lawsuit against construction companies, alleging violation of workers compensation acts in not paying proper overtime wages.

Jeffrey W. Terry filed a complaint, individually and on behalf of all others similarly situated, Feb. 6 in the Houston Division of the Southern District of Texas against Chicago Bridge & Iron Company also known as CB&I and CB&I Inc., and Stone and Webster Construction Services LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, Terry regularly worked as a safety supervisor in excess of 40 hours per week without receiving proper overtime compensation. Instead, the suit says, he was paid straight time only. 

The plaintiff alleges the defendants failed to pay his overtime hours at a rate equal to one-and-one-half times his regular rates of pay for every hour worked over 40 per week as required by FLSA.

Terry seeks trial by jury, compensation for all unpaid overtime wages, liquidated damages, court costs and attorney fees and all other just and equitable relief.
