HOUSTON — A Harris County woman is suing insurance providers, alleging violation of workers compensation acts in not paying proper overtime.
Belinda Tamez filed a complaint Feb. 7 in the Houston Division of the Southern District of Texas against
Suzanne Brown Agency LLC and Suzanne L. Brown,
alleging they intentionally and willfully violated the Fair Labor Standards Act.
According to the complaint, between Dec. 16, 2015 and Sept. 15, 2016, she worked an average of approximately 15 overtime hours per week as an inside saleswoman with Suzanne Brown Agency without receiving overtime compensation. Instead, the suit says, Tamez was paid a rate of $45,000 per year, plus commissions.
The plaintiff alleges the defendants failed to compensate her at a rate not less than one and one-half times her regular rate for each hour worked more than 40 per week as required by FLSA.
Tamez seeks trial by jury, all unpaid overtime wages, liquidated damages, attorney fees, court costs and all other equitable relief. She is represented by attorneys Thomas H. Padgett Jr. of Ross Law Group in Bellaire, and by Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin.
