HOUSTON — A vacuum installer has filed a class action lawsuit against a Houston company, alleging failure to compensate employees for overtime work.

Jaime Villanueva, individually, and on behalf all others similarly situated filed a complaint March 13, in the Houston Division of the Southern District of Texas against Southern Tubulars Services LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, Southern Tubulars Services employees exclusively worked 12 and 13 hours a day and are supposed to be paid based upon the hours they work. The suit says despite regularly working more than 40 hours a week, the employees were paid straight time.

As a result, Villanueva and other vacuum installers were not compensated for overtime hours at one and one-half of the regular rate for the hours worked past 40 each week as required by FLSA.

The plaintiff alleges the defendant failed to pay overtime wages. 

Villaneuva seeks a trial by jury, unpaid overtime compensation, liquidated damages, attorney fees, costs, post-judgment interest and all other just relief. He is represented by attorney Taft L. Foley, II of The Foley Law Firm in Houston.
