Safe technician accuses employers of unpaid overtime wages

Late 02

HOUSTON — A Fort Bend County safe technician is suing a Williamson County business, alleging violation of workers compensation acts in failing to pay overtime.

Allen Racy filed a complaint March 24 in the Houston Division of the Southern District of Texas against CW Wynn LLC and Charles William Wynn, alleging violation of the Fair Labor Standards Act.

According to the complaint, beginning Feb. 1, 2014, and through the filing date of this complaint, Racy did not receive overtime compensation in the weeks he worked more than 40 hours. Instead, the suit says, he was paid a flat salary, plus occasional commission pay. The plaintiff alleges the defendants misclassified him as exempt from overtime and deprived him of time and a half overtime compensation to which he was entitled under FLSA.

Racy seeks trial by jury, actual and liquidated damages, plus interest, court costs, reasonable attorney fees and all other proper relief. He is represented by attorney Ahad Khan of Houston.
