Tenant alleges apartment owners failed to keep premises safe

HOUSTON — A tenant is suing the owners of a Houston apartment complex, alleging their negligence led to him being assaulted and shot. 

Francisco Villacardenas filed a complaint March 24 in Harris County Circuit Court against Willow Brook Crossing Apartments, Westdale Willow Brook TX LP., and Westdale Asset Management LTD, alleging they failed to maintain, inspect and take reasonable precautions to protect its tenants.

According to the complaint, on Nov. 10, 2016, Villacardenas as was physically assaulted, robbed and shot in the head and shoulder while on the premises of Willow Brook Crossing Apartments in Houston. As a result, Villacardenas says he has suffered physical injuries, trauma and medical expenses. 

The plaintiff alleges the defendants failed to provide security measures on the premises, failed to adequately warn invitees or tenants of the unsafe conditions of the area and failed to enforce and implement proper polices, rules and procedures to make the property reasonably safe.

Villacardenas seeks trial by jury, judgment to recover damages in accordance with the evidence, costs of court, interest and all other just and equitable relief.
