Former Eskimo Insulation driver claims he is owed thousands for unpaid overtime

HOUSTON – A Houston man alleges his former The Woodlands employer owes him more than $13,000 in unpaid overtime wages.

Hector Molina, individually and on behalf of all others similarly situated, filed a complaint on May 9 in the Houston Division of the Southern District of Texas against Eskimo Insulation LLC alleging that the spray foam insulation company violated the Fair Labor Standards Act.

According to the complaint, the plaintiff was employed as a driver for the defendant from June to December 2016. He alleges that he regularly worked more than 65 hours per week without receiving proper overtime compensation for all hours worked over 40 per week. The plaintiff alleges the unpaid overtime wages owed is approximately $12,338. 

The plaintiff holds Eskimo Insulation LLC responsible because the defendant allegedly failed to properly compensate plaintiff for hours worked over 40 hours per week at a rate of not less than one-and-a-half his regular rate.

The plaintiff requests a trial by jury and seeks an order certifying this action as a collective action, award for unpaid wages, liquidated damages, attorneys’ fees and expenses and any other relief to which plaintiff may be justly entitled. He is represented by Alfonso Kennard Jr. and José E. Galvan of Kennard Richard PC in Houston.
