BEAUMONT – Discovery issues seem to be ongoing in a trip and fall lawsuit brought against Casa Ole.
Seeking up to $1 million in damages, Linda Sue Friend filed her suit Nov. 15 in Jefferson County District Court.
According to the complaint, on Dec. 9, 2014, nearly two years prior to the suit being filed, Friend was walking into the entrance of the Casa Ole in Beaumont when she tripped “due to poor design and lighting” outside of the restaurant.
Court records show that on April 17 Casa Ole filed a motion to compel discovery, stating Friend has failed to adequately respond to discovery requests related to her medical history and employment history.
A hearing on the matter was set for May 15 but was canceled.
In her suit, Friend alleges Casa Ole negligently failed to make sure the premises was safe from defects.
She is suing for her past and future mental anguish, pain, disfigurement and lost wages.

Judge Justin Sanderson, 60th District Court, has been assigned to the case.
