HOUSTON — A Texas worker is suing, alleging unsafe working conditions and a manufacturing defect led to injuries for the plaintiff.

John Hernandez filed a complaint July 5 in Harris County District Court against Quintanilla Management Company, EOG Resources Inc. and Smeal Manufacturing LLC, alleging they failed to provide adequate safety guards.

According to the complaint, on March 7, while Hernandez was working on EOG's water well in Gonzales, Texas, he was severely injured when a well weight manufactured by Smeal fell directly on his head.

Hernandez said he suffered physical and mental pain, loss of earnings and medical expenses. The plaintiff alleges the defendants failed to implement adequate safety policies and procedures.

Hernandez seeks trial by jury, monetary relief of more than $1 million and all other lawful and equitable relief. He is represented by attorneys Robert C. Hillard, Catherine D. Tobin, John B. Martinez, T. Christopher Pinedo, Celeste Baltirra and Jose Luis Munoz of Hillard Munoz Gonzales LLP in Corpus Christi, and by Juan P. Reyna of J. Reyna Law Firm PC, also in Corpus Christi.
