Consumer claims Westside Lexus failed to disclose vehicle had been in accident

HOUSTON – A Harris County auto dealer is accused of failing to tell a consumer that a vehicle she purchased had been in an accident.

Carolyn Guidry filed a complaint on July 28 in the Harris County District Court against Westlex Corp., doing business as Westside Lexus, citing the Texas Deceptive Trade Practices Act and fraud.

According to the complaint, the plaintiff purchased a 2014 Lexus LS 460 from the defendant for $77,288.56 in January 2015. She alleges she later discovered when she traded in the car two years later that the vehicle had been in an accident and repaired with automotive body filler, which had not been disclosed to her at the time of purchase. She alleges because of the accident, the vehicle was worth $13,000 less.

The plaintiff holds Westlex Corp. responsible because the defendant allegedly made false representations to the plaintiff regarding the vehicle with the intent the plaintiff would rely on them to purchase the vehicle.

The plaintiff seeks damages of less than $100,000 and all other relief to which she may be entitled. She is represented by R. Douglas Scott of Law Offices of Craig Zimmerman in Arlington.
