Man trips over package while exiting home, sues Fedex for $1M

BEAUMONT – Fedex was recently hit with a $1 million lawsuit, brought by a man who allegedly tripped and fell over a package while exiting his home.

Contending the defendants acted with gross negligence, Rickie Collins and his wife, Sammie, filed their suit against Fedex and the man who delivered the package, Marcus Hargrave, on July 25 in Jefferson County District Court.

According to the lawsuit, on Feb. 3, 2016, Rickie Collins injured his shoulder, knee and arm when he fell over a large box placed in the doorway of his home without consent or warning by Hargrave.

“When attempting to exit his home, he fell over the box,” the suit states. “Plaintiffs will further show that the negligence of the defendants constitutes gross negligence, or malice, as that term is defined by law. Accordingly, plaintiffs are entitled to … punitive damages.”

Rickie Collins is also suing for his past and future medical expenses, impairment, lost earnings, mental anguish, loss of consortium and loss of household services.

His wife is suing for her loss of consortium, mental anguish and loss of household services.

Beaumont attorney Paul “Chip” Ferguson Jr. represents them.

Judge Baylor Wortham, 136th District Court, has been assigned to the case.
