Consumer seeks refund of deposit made to Scott Thomas Homes

HOUSTON – A Harris County resident is seeking the return of a deposit he had placed on a property.

Jacob Rodriguez filed a complaint on Aug. 2 in the Harris County District Court against Scott Thomas Homes LLC alleging breach of contract and fraud in the sale of real estate.

According to the complaint, the plaintiff and defendant entered a contract with the defendant for a home in Cypress and the plaintiff deposited $10,000. The suit states the plaintiff did not qualify for the loan he had applied for and in May sent the defendant a notice of the denial and a demand for the return of his deposit per their contract.

The plaintiff holds Scott Thomas Homes LLC responsible because the defendant allegedly failed and refused to return plaintiff's earnest money and misrepresented that it owned the property when it did not.

The plaintiff requests a trial by jury and seeks actual and nominal damages, pre- and post-judgment interest, attorney's fees, costs and any other relief of which he is entitled. He is represented by Jason D. Kraus of The Kraus Law Firm in Houston.
