Woman alleges glove was in drink ordered from McDonald's

BEAUMONT – A Jefferson County woman has filed suit after finding a latex glove in a drink purchased from a Beaumont McDonald's.

Tracy Samuels filed a complaint on Aug. 9 in the Jefferson County District Court against BG Foods Inc., doing business as McDonald's Restaurant No. 6339 and McDonald's Corp., alleging negligence.

According to the complaint, the plaintiff alleges that on Sept. 25, 2016, she ordered food from the drive-thru lane at the defendants' restaurant. She alleges that after she had consumed the meal, she opened the lid to her beverage and found a latex glove in her drink. She alleges she sought medical treatment and incurred expenses.

The plaintiff holds BG Foods Inc. and McDonald's Corp. responsible because defendants' employees allegedly failed to exercise reasonable care in preparing the beverage and negligently hired and/or retained employees or contractors.

The plaintiff requests a trial by jury and seeks monetary relief of $100,000 or less and such other just and proper relief. She is represented by Lee S. Perez and John Arthur Daspit of Daspit Law Firm in Houston.
