Mistrial declared in Mostyn Law $1M hail suit against USAA

HIDALGO COUNTY – A mistrial has been declared in a Mostyn Law hail lawsuit against USAA Texas Lloyd’s.

Seeking up to $1 million in damages, David and Valerie Calvillo filed suit against USAA on June 26, 2014, in Hidalgo County District Court.

The couple claims their McAllen home was damaged two years prior to the filing of the litigation in the March 29, 2012, hail storm that ravaged the area.

The plaintiffs allege USAA failed to perform a reasonable investigation of their claim, which resulted in an unfair settlement.

The case was called up for trial on Aug. 24. A mistrial was declared four days later.

Mostyn Law is located in Houston, which has been pounded by the remnants of Hurricane Harvey.

Mostyn Law attorney Gregory Cox, who is located in Beaumont, is handling the case.

In addition to fraud, the plaintiffs allege breach of contract and noncompliance with the Texas Insurance Code.

They are suing for actual and exemplary damages.
