San Leon man alleges he lost finger because physician failed to treat infection

GALVESTON – A San Leon man alleges a doctor failed to diagnose and treat an infection in his hand.

James Austin Dupree filed a complaint on Sept. 27 in the Galveston County District Court against Dr. Emmie H. Ko alleging negligence.

According to the complaint, the plaintiff that he presented to Ko in October 2015 with complaints of right thumb pain. The plaintiff alleges that the defendant received the results of a culture done in October in December that indicated the presence of mycobacterium marinum but did not order an antibiotic or infectious disease consult.

The suit states the plaintiff continued to see the defendant with complaints of pain in his hand and sought additional treatment from another doctor in March 2016. The suit states he learned that the infection was untreated and that the plaintiff lost his right ring finger in an effort to fight the infection.

The plaintiff holds Ko responsible because the defendant allegedly failed to administer appropriate antibiotics and failed to promptly order an infectious disease consultation.

The plaintiff requests a trial by jury and seeks damages in excess of the minimum jurisdictional limits of the court, exemplary damages, interest, costs and such other just and equitable relief.
