Pipefitter alleges Blanchard Refining Co. terminated him after injury

GALVESTON – A Texas City employer is alleged to have retaliated against a 10-year pipefitter employee after his injuries.

David Garza filed a complaint on Oct. 10 in the Galveston County District Court against Blanchard Refining Co. LLC alleging workers' compensation retaliation.

According to the complaint, the plaintiff alleges that when he sustained an on-the-job injury on Dec. 22, 2014, he was demoted and after his second on-the-job injury on Sept. 22, 2016, he was terminated. 

The plaintiff holds Blanchard Refining Co. LLC responsible because the defendant allegedly retaliated against him after he notified his employer of the injuries and initiated workers' compensation claim filings.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but not more than $1 million and such other general and special relief. He is represented by Javier R. Espinoza and Steven Sachs of Espinoza Law Firm PLLC in San Antonio.
