Defendant motorist says police report shows he was pushed into vehicle, seeks summary judgment in $1M suit

BEAUMONT – A defendant in an automobile collision lawsuit is seeking summary judgment, arguing that a police report shows his vehicle was pushed into the plaintiff’s vehicle after he was rear-ended.

Seeking more than $1 million in damages, Michelle Elizabeth Walton filed suit against Fidelity Freight on Nov. 3, 2015 in Jefferson County District Court.

Raymond Haywood, Ngan Nguyen and Dustin Denmon are also named as defendants.

According to the lawsuit, on Oct. 16, 2015, Walton was driving east on I-10 in Jefferson County. Haywood was driving a vehicle owned by Fidelity Freight and traveling behind Denman.

In her suit, Walton accuses both Haywood and Denman of negligently failing to avoid colliding with her vehicle.

On Sept. 6, Denmon filed a traditional and no-evidence motion for summary judgment, court records show.

Denmon asserts the police report from the accident shows his vehicle was pushed into Walton’s and that enough time for discovery has passed.

A hearing on the matter was set for Oct. 16 but was cancelled, according to a courthouse official.

Walton is alleging gross negligence and is suing for her past and future mental anguish, pain, medical expenses, impairment, disfigurement and lost wages.

She is represented by the Law Offices of Thomas J. Henry in Corpus Christi.

Judge Kent Walston, 58th District Court, has is assigned to the case.
