Sales manager alleges Chamberlain Group Inc. terminated him after requesting accommodation for disability

HOUSTON – A Harris County man alleges he was terminated by his employer after formally requesting accommodations for his disability.

Paul von Dresky filed a complaint on Oct. 23 in the Houston Division of the Southern District of Texas against The Chamberlain Group Inc. alleging violation of the Americans with Disabilities Act and other counts.

According to the complaint, the plaintiff was hired by the defendant in November 2005 and by 2013, became a district sales manager. The suit states in 2013, the plaintiff's genetic condition caused herniated discs in his back and subsequent back surgery.

In January 2015, the suit states the plaintiff requested accommodations under the ADA. The suit states he was later terminated in April 2015.

The plaintiff holds The Chamberlain Group Inc. responsible because the defendant allegedly failed to make reasonable accommodations, retaliated against him and terminated his employment for engaging in protected activity and tortiously interfered with his contracts and business relationships.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, pre- and post-judgment interest, costs and expenses of this action and such other just and equitable relief. He is represented by Derek Hoffpauir of Law Office of Derek Hoffpauir PLLC in Kingwood.
