BEAUMONT – A Newton resident is seeking damages from a Lumberton individual and an insurance company after an auto accident in Beaumont.
Nancy Hopson filed a complaint on Nov. 3 in the Jefferson County District Court against David Calvin Smylie and Texas Farm Bureau Casualty Insurance Co. alleging negligence.
According to the complaint, the plaintiff alleges that on June 28, she was driving her motor vehicle on Major Drive in Beaumont and was stopped for traffic when defendant Smylie violently struck the rear of her vehicle. She alleges she sustained severe and disabling injuries resulting in pain and suffering disfigurement, loss of household services and medical and health care-related expenses.
The plaintiff holds Smylie and Texas Farm Bureau Casualty Insurance Co. responsible because defendant Smylie allegedly failed to maintain careful lookout and failed to timely apply brakes of take evasive actions to avoid collision. She also alleges she is entitled to uninsured/underinsured motorist coverage from Texas Farm Bureau Casualty Insurance Co.
The plaintiff requests a trial by jury and seeks damages in excess of the court's minimum jurisdiction, pre- and post-judgment interest, attorney's fees, costs and such other relief that are lawful and equitable.
