MARSHALL – The parents of a man who died from injuries after a classic car rolled off of a trailer and into his pickup are suing the makers of the tie-downs used to secure the car.
Jenica Denise Turner, individually and on behalf of the estate of John Alan Turner, and James Alton Turner filed a complaint on Nov. 9 in the Marshall Division of the Eastern District of Texas against Hampton Products International Corp. alleging design defect and failure to warn.
According to the complaint, the plaintiffs allege that on March 1, their decedent John Alan Turner was operating a Chevrolet pickup truck traveling on Toll 49 behind a Ford pickup truck with a trailer loaded with a classic Ford Mustang. The suit states the tie-downs securing the Mustang broke, causing the Mustang to roll off the trailer and crash into the front-end of John Alan Turner’s pickup. The suit states John Alan Turner suffered catastrophic injuries that resulted in his death.
The suit states the defendants manufactured the tie-downs used to secure the Mustang.
The plaintiffs holds Hampton Products International Corp. responsible because the defendant allegedly labeled and packaged the tie-downs in such a manner that the actual working load limit and the rated load was unclear and confusing to the ordinary user or consumer.
The plaintiffs request a trial by jury and seek final judgment for all damages, costs and interest. They are represented by Jeffery T. Embry and George Cowden IV of Hossley & Embry LLP in Tyler.
