HOUSTON – A New Caney consumer alleges he has been harassed with calls from a debt collector.
Terry Wayne Hughes filed a complaint on Nov. 10 in the Houston Division of the Southern District of Texas against National Credit Adjusters LLC alleging that the debt collector violated the Fair Debt Collection Practices Act and the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that for the last several years, he has been receiving calls to his cellular phone from the defendant attempting to collect an alleged debt. He claims he has demanded that the defendant stop contacting him, but the calls continue.
As a result, he alleges he has been unfairly and unnecessarily harassed and distressed and was caused to suffer increased usage of telephone services, loss of cellular phone capacity and diminished cellular phone functionality.
The plaintiff holds National Credit Adjusters LLC responsible because the defendant allegedly continuously called plaintiff's cellular phone even after being notified to stop and made calls using an automatic telephone dialing system.
The plaintiff requests a trial by jury and seeks damages of at least $500 per phone call under the TCPA, punitive damages, costs and attorney fees and any other just and appropriate relief.
