Directional Project Support Inc. alleged to have failed to pay overtime wages

HOUSTON – A class action has been filed against a horizontal directional drilling company over allegations it failed to pay overtime wages.

Frank Arredondo, individually and on behalf of all others similarly situated, filed a complaint on Nov. 13 in the Houston Division of the Southern District of Texas against Directional Project Support Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he routinely worked more than 40 hours in a workweek on defendant’s behalf but was not lawfully paid for all work done in excess of 40 hours per week. 

The plaintiff holds Directional Project Support Inc. responsible because the defendant allegedly misclassified him as an independent contractor and paid him on a day-rate basis only with no overtime premium pay for his overtime hours worked.

The plaintiff seeks unpaid back wages, liquidated damages, costs, attorneys’ fees, interest and such other necessary and appropriate relief. He is represented by Jay Forester of Forester Law PC in Dallas.
