Patron seeks $1 million from Blur Bar after auto accident caused by allegedly intoxicated driver

HOUSTON – A patron of a bar is seeking $1 million in damages after he was injured in a single-vehicle accident.

Iban Martinez filed a complaint on Nov. 12 in the Harris County District Court against Montrose Entertainment Corp. Inc., doing business as Blur Bar, alleging that the nightclub operator violated the Dram Shop Act.

According to the complaint, the plaintiff alleges that on March 24, he was a passenger in a motor vehicle being driven by Annecia Martinez. The suit states they were patrons at the defendant's bar and that the defendant served Annecia Martinez alcohol in large quantities. The suit states because of Annecia Martinez's intoxicated state, she drove off the road and into several trees. The plaintiff alleges he suffered severe injuries as a result.

The plaintiff holds Montrose Entertainment Corp. Inc., doing business as Blur Bar, responsible because the defendant allegedly negligently sold or served alcoholic beverages to an obviously intoxicated person.

The plaintiff seeks monetary relief of more than $1 million and such other general and special relief. He is represented by Muhammad S. Aziz of Abraham, Watkins, Nichols, Sorrels, Agosto and Aziz in Houston.
