The Spot guest alleges she was not warned of stair's condition before fall

GALVESTON – A Harris County woman alleges poorly maintained steps caused her to fall at a business.

Norma Herrera filed a complaint on Nov. 14 in the Galveston County District Court against Island Famous Hospitality No. 1 Inc., doing business as The Spot, alleging negligence.

According to the complaint, the plaintiff alleges that on Nov. 25, 2016, she was an invitee at defendant's business. While leaving the premises, the suit states she tripped and fell due to poorly maintained steps. She alleges she sustained injuries resulting in pain and suffering, medical expenses, mental anguish and lost income. 

The plaintiff holds Island Famous Hospitality No. 1 Inc. responsible because the defendant allegedly failed to provide adequate warning of the existence of the unsafe and dangerous condition.

The plaintiff seeks actual and special damages, costs of court, pre- and post-judgment interest and such other legal and equitable relief. She is represented by David K. Mestemaker, Norman Straub, Van Gardner and Jonathan B. Zumwalt of Mestemaker & Straub in Houston.
