Woman alleges Stoneleigh Gardens Associates apartment had toxic mold

HOUSTON – A Spring woman alleges the owners of an apartment failed to discover and remove toxic mold.

Marnie Smith filed a complaint on Nov. 16 in the Harris County District Court against Stoneleigh Gardens Associates LLC and SDN Stoneleigh LLC alleging premises liability.

According to the complaint, on Oct. 6, 2016, the plaintiff entered into an agreement to lease an apartment owned by the defendants. She alleges she was injured by persistent toxic mold in the apartment's interior.

The plaintiff holds Stoneleigh Gardens Associates LLC and SDN Stoneleigh LLC responsible because the defendants allegedly failed to warn her of the existence of toxic mold and failed to properly maintain and inspect the plumbing.

The plaintiff seeks an award for monetary relief of $100,000 or less, attorney's fees and costs. She is represented by Matthew L. Pepper of Matthew L. Pepper Attorney At Law in Spring.
