Former Houston Emergency Auto Rescue & Trucking dispatcher alleges she is owed unpaid overtime

HOUSTON – A former dispatcher for a towing company alleges she was paid the same rate regardless of the amount of hours she worked.

Zerenia White filed a complaint on Nov. 17 in the Houston Division of the Southern District of Texas against Houston Emergency Auto Rescue & Trucking LLC alleging that the towing company violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she regularly worked more than 40 hours per week for the defendant without receiving overtime premiums for the additional hours. The suit states she was employed by the defendant from July 1, 2015, to July 27, 2017, and worked an average of 55 hours per week.

The plaintiff holds Houston Emergency Auto Rescue & Trucking LLC responsible because the defendant allegedly refused to pay proper overtime compensation at a rate of time-and-a-half of her regular rate for all overtime hours worked.

The plaintiff seeks all unpaid overtime wages, liquidated damages, attorneys’ fees, costs, pre- and post-judgment interest and such other relief as to which she may be entitled. She is represented by James M. Loren, George Z. Goldberg and Rachael Rustmann of Goldberg & Loren PA in Dallas.
