HOUSTON – A homebuilding company alleges an individual made false representations regarding projects.
Eagle Rock Custom Homes Inc. and Mark Davis filed a complaint on Nov. 20 in the Harris County District Court against Jeff Fisher alleging fraudulent inducement, common law fraud and other counts.
According to the complaint, the defendant approached the plaintiffs with a joint venture proposition. The suit states that a lot would be deeded to the plaintiffs to allow them to seek a construction loan for a home for a third party while Fisher would provide financing or arrange for a loan.
The plaintiffs allege that when some of the projects came up for sale, Eagle Rock lost the sale of the properties because either they were not transferable to it or fees were added to the original agreement.
The plaintiffs seek monetary relief of more than $1 million and such other lawful and equitable relief. They are represented by Chuck Portz of Portz, Portz & Pena in Houston.
