HOUSTON – A Houston company alleges that it is owed a fee after a Virginia company canceled an order for manufactured goods.
ERS Rental Solutions LLC, doing business as Energy Rental Solutions, filed a complaint on Nov. 21 in the Harris County District Court against M.C. Dean Inc. alleging breach of contract.
According to the complaint, the plaintiff alleges that on Sept. 1, 2016, defendant contracted plaintiff to specially manufacture goods to be leased and delivered to defendant for a total cost of $43,014.96 with cancellation fee of $36,246.65.
The plaintiff holds M.C. Dean Inc. responsible because the defendant allegedly canceled the delivery of the goods ordered and failed and continues to refuse to pay the cancellation fees. The plaintiff alleges it was damaged for the costs expended in manufacturing the ordered goods and for not receiving cancellation fees.
The plaintiff requests a trial by jury and seeks damages on the amount of $36,246.65, pre- and post-judgment interest, attorney's fees, costs and such other legal and equitable relief. It is represented by Dean G. Pappas and Mary M. Markantonis of Dean G. Pappas Law Firm PLLC in Houston.
