Father seeks damages from Houston Foam Plastics Inc. after son injured on job

HOUSTON – A father is suing Houston Foam Plastics Inc. after his son was injured in an industrial accident.

Bertoldo Balderas, as next friend of Rigoverto Balderas, filed a complaint on Nov. 21 in the Harris County District Court against Houston Foam Plastics Inc. alleging negligence.

According to the complaint, Rigoverto Balderas was a temporary employee of Port City Staffing assigned defendant's premises to work as a forklift operator. The suit states the defendant asked Rigoverto Balderas to undertake the task assignment of grinder operator and that on Dec. 17, 2015, he was caught in the machine. The suit states the severity of his injuries caused him to be physically and mentally disabled. 

The plaintiff holds Houston Foam Plastics Inc. responsible because the defendant allegedly negligently switched Rigoverto Balderas from forklift operator to the grinder, which was a machine which Rigoverto Balderas was not familiar with or employed to operate.

The plaintiff requests a trial by jury and seeks actual and exemplary damages, pre- and post-judgment interest, costs of court and all other lawful and equitable relief. He is represented by Robert O'Conor Jr. and Helen D. O'Conor of The Law Offices of Robert O'Conor Jr. in Houston.
