Consumer claims Compass Bank calls harassed him

GALVESTON – A Galveston consumer alleges an Alabama business harassed him with calls.

Michael Burke filed a complaint on Dec. 4, 2017, in the Galveston Division of the Southern District of Texas against Compass Bank alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that beginning in January 2017, he received several calls to his cellular telephone from the defendant that directly interfered with his right to peacefully enjoy services for which he paid. Is a result, he claims he was annoyed, harassed and inconvenienced. 

The plaintiff holds Compass Bank responsible because the defendant allegedly made calls using an automatic telephone dialing system and/or artificial or pre-recorded voice message and continued to call after he requested that the calls stop.

The plaintiff requests a trial by jury and seeks statutory damages of $500 for each negligent violation and treble damages of $1,500 for each willful violation of the TCPA and such other just and proper relief. He is represented by Jenny DeFrancisco of Lemberg Law LLC in Wilton, Connecticut.
