Registered nurse alleges Certified EMS Inc. failed to pay overtime wages

HOUSTON – A registered nurse has filed a class-action lawsuit against a medical staffing agency over allegations that it failed to pay overtime compensation.

Laurie Fleming, individually and on behalf of all others similarly situated filed a complaint on Dec. 18, 2017, in the Houston Division of the Southern District of Texas against Certified EMS Inc., doing business as CPNS Staffing, et al. alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff is a registered nurse and former employee of the defendants who was staffed by CPNS to work at the Cornerstone Hospital of Houston. She alleges she worked more than 40 hours per week.

The plaintiff holds Certified EMS Inc., doing business as CPNS Staffing, et al. responsible because the defendants allegedly did not compensate her at the FLSA-mandated rate of time-and-a-half for hours worked in excess of 40 per work week.

The plaintiff requests a trial by jury and seeks all unpaid wages and unpaid overtime compensation, liquidated damages, attorney’s fees, litigation expenses and costs, pre- and post-judgment interest and such other just and appropriate relief.
