HOUSTON – A man alleges he was terminated by his auto dealership employer because of his age.

William E. Davis filed a complaint on Dec. 18, 2017, in the Houston Division of the Southern District of Texas against Don Elliott Chevrolet Inc. alleging that the former employer violated the Americans with Disabilities Act and the Age Discrimination in Employment Act.

According to the complaint, the plaintiff was employed as the defendant's finance director at Don Elliot Autoworld and was terminated in November 2015 at the age of 76. He alleges he was replaced by a younger employee. The suit also mentions the plaintiff had a heart attack in February 2015.

The plaintiff holds Don Elliott Chevrolet Inc. responsible because the defendant allegedly intentionally discriminated against him because of his age and disability and terminated his employment because of these factors.

The plaintiff requests a trial by jury and seeks judgment for all damages, reinstatement in his former position, attorneys’ fees and cost and other and further relief. He is represented by John F. Melton of The Melton Law Firm PLLC in Austin.
