Property owners claim Epik Poolscapes defectively designed pool

GALVESTON – A League City couple alleges that a swimming pool they had installed on their property was defectively constructed and is damaging the property.

Gene Arthur and Linda Arthur filed a complaint on Dec. 19, 2017, in the Galveston County District Court against Pier-A-Mid Rehabilitation, Conrad Deleon, individually and doing business as Epik Poolscapes, et al. alleging breach of contract and other counts.

According to the complaint, the plaintiffs contracted Epik Poolscapes in 2014 to construct a pool, pool decking, fire pit and outdoor kitchen at their home. The plaintiffs allege the construction was completed in March 2015 and noticed cracks around the pool in 2016. They allege they later discovered Epik's work was defective and because it refused to repair the work, Pier-A-Mid was hired to repair the issues but abandoned the job in July 2017.

The plaintiffs hold Pier-A-Mid Rehabilitation, Conrad Deleon, individually and doing business as Epik Poolscapes, et al. responsible because the defendants allegedly defectively designed and constructed plaintiffs' pool and/or abandoned the job.

The plaintiffs request a trial by jury and seek monetary relief of more than $200,000 but not more than $1 million and such other and further relief that are just and proper. They are represented by Jason E. Williams and Erin M. Bullard of Bissinger, Oshman & Williams LLP in Houston and Robert Arthur and Kirby Grove of BoyarMiller in Houston.
