Alco Collections Inc. alleged to have violated debt collection laws in letter to consumer

HOUSTON – A Houston consumer has filed suit against a debt collector over the contents in a letter it sent her.

Monique Spencer, individually and on behalf of all others similarly situated, filed a complaint on Dec. 21, 2017, in the Houston Division of the Southern District of Texas against Alco Collections Inc. and John Does 1-25 alleging that they violated the Fair Debt Collections Practices Act.

According to the complaint, the defendant contacted the plaintiff regarding an alleged debt owed to Chateau Wein Apartments. She alleges the letter the defendant sent on Dec. 30, 2016, provided false information about the correct method to validate the alleged debt. She also states that the letter's G-Notice failed to include the words "in writing" and is deficient.

The plaintiff requests a trial by jury and seeks an order certifying this action as a class action appointing plaintiff and her counsel as representatives of the class, actual and statutory damages, attorney's fees, costs and expenses and such other just and proper relief. She is represented by Jonathan Kandelshein of The Law Office of Jonathan Kandelshein in Dallas.
